Within the scope of the Law No. 6698 on the Protection of Personal Data, we kindly ask you to read this text in order to be informed about your rights and authorizations regarding your personal data, and after reading and understanding it, if you have explicit consent to the processing, storage and transfer of your personal data within the scope specified below, we kindly ask you to confirm by clicking the checkbox below.

 1. What is personal data?

Any information relating to an identified or identifiable natural person constitutes personal data. Any information such as your name, surname, date of birth, place of birth, address, telephone number, e-mail that reveals your identity and enables you to be distinguished from other people constitutes personal data.

 2. How and on what basis are your personal data processed?

The procedures and principles stipulated in Law No. 6698 and other laws are taken into consideration in the processing of your personal data. We process your personal data within the framework of our authorities and obligations arising from the legislation, in accordance with the law and good faith, for specific, clear, legitimate purposes and within the framework of your consent. In this context, the data provided by you such as name, surname, company name, address, country name, telephone and e-mail are processed in order to be used in transactions such as delivering the products you have ordered through www.sgiplastik.com, completing the payment transaction related to your order and issuing and delivering your invoice to you. Your personal data is stored in our database available in electronic environment. Our IT department makes the utmost effort to keep your personal data accessible to a minimum number of people and to prevent third parties from obtaining it. The personal data you share with us is shared with third parties only when necessary and only with your consent, such as sharing your address with the cargo company for the delivery of your order. Otherwise, your personal data is meticulously protected and not shared with third parties. In order to ensure the security of your personal data, our company also ensures the security of your personal data by conducting in-house trainings, making limited authorization, taking contractual commitments in internal and external relations and foreseeing responsibility and deterrent sanctions.

3. How long will your personal data be kept?

Your personal data will be kept for at least the period required by legal obligations and in any case until the statute of limitations stipulated by the legislation expires, taking into account the periods for which the Turkish Commercial Code, Turkish Code of Obligations, tax legislation and other laws hold ENEM GLOBAL responsible as a seller/supplier.

4. Is it possible to process personal data in the absence of explicit consent, in which cases can personal data be processed in the absence of explicit consent?

As a rule, personal data cannot be processed without the explicit consent of the data subject. However, in the presence of one of the conditions listed in the law, it is possible to process personal data without the explicit consent of the data subject. These conditions can be listed as follows:

a) It is clearly stipulated in the laws.

b) It is mandatory for the protection of the life or physical integrity of the person who is unable to disclose his/her consent due to actual impossibility or whose consent is not legally valid.

c) Provided that it is directly related to the establishment or performance of a contract, it is necessary to process personal data belonging to the parties to the contract.

ç) It is mandatory for the data controller to fulfill its legal obligation.

d) It has been made public by the data subject himself/herself.

e) Data processing is mandatory for the establishment, exercise or protection of a right.

f) Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

5. In which cases and when will your personal data be deleted?

Although it has been processed in accordance with the conditions we have explained above, if the reasons requiring the processing of your personal data disappear, the personal data will be deleted, destroyed or anonymized by TÜMKİAD, the data controller, ex officio or upon your request. Anonymization means that personal data cannot be associated with an identified or identifiable natural person under any circumstances, even by matching with other data.

6. In which cases are your personal data transferred to third parties?

Your personal data may be transferred to third parties with your explicit consent. It is inevitable for us to share some of your personal data with third parties in order to fulfill the obligations we have undertaken as a Seller in the distance sales contract we have undertaken with our customers and for legitimate purposes.

In addition, your personal data listed in Article 6 of this text, which can be processed legally even without your explicit consent, may also be shared with third parties without your explicit consent.

ENEM GLOBAL, for reasons arising from the Turkish Commercial Code, Turkish Code of Obligations, tax legislation and other relevant legislation, to keep my personal data (Name, Surname, Company Name, Address, Country Name, Telephone and e-mail) and in the electronic system / database where personal data is kept in cases where the legislation allows or obliges, I agree that my personal data shall be processed, retained for the periods stipulated by the legislation and until the reasons requiring the processing of my personal data are eliminated, and shared with third parties expressly authorized by the legislation, persons residing abroad and authorized administrative and judicial bodies without my separate consent.
